Terms of Service

These Terms govern the contracting and use of services offered by Nebular at nebularws.com. By purchasing any service or creating an account, you fully accept these Terms, the Privacy Policy, and the Acceptable Use Policy.

1. Definitions

For purposes of these Terms, 'Nebular' is the legal entity operating services at nebularws.com; 'Customer' is the contracting individual or legal entity; 'Services' cover VPS, hosting, business e-mail, domains, malware removal and other products; 'Account' is the Customer's individual registration; 'Platform' is the set of systems and interfaces provided.

2. Acceptance

By purchasing a service, creating an account, or using the Platform, the Customer declares legal capacity and full acceptance of these Terms and related documents. Acceptance is formalized at checkout and produces contractual effects from payment confirmation. If you disagree with any clause, do not use the services.

3. Registration and account

The Customer is responsible for providing truthful, complete, and up-to-date information. Access credentials are personal and non-transferable; the Customer is liable for all activity originating from the account, except for provably unauthorized access. Two-factor authentication is strongly recommended.

4. Description of services

Nebular provides virtual infrastructure (VPS), shared hosting, business e-mail, domain registration, security services, malware removal, and technical support. Technical specifications appear on each plan's page. Non-disruptive updates may occur without notice; material changes are communicated at least 30 days in advance.

5. Plans, pricing, and payment

Current prices appear on the site and are charged in BRL; conversions to other currencies are indicative. Accepted methods: credit card, bank slip (boleto), and Pix. Cycles: monthly, annual (10% off), and triennial (32% off, price locked for 3 years). Non-payment for more than 10 days triggers suspension; after 30 days, final termination with data deletion.

6. Renewal, cancellation, refund

Annual and triennial cycles renew automatically unless canceled at least 7 days before due date. Cancellation can be done anytime via panel or WhatsApp, no penalty. We offer an unconditional 90-day guarantee from first purchase — unhappy, get a 100% refund. After 90 days, refunds are prorated to unused time.

7. Acceptable use policy

It is strictly forbidden to use the services for illegal activities, distribution of malware, phishing, or spam, copyright infringement, hosting of child abuse content, violence or incitement to crimes, unauthorized cryptocurrency mining, bulk e-mail sending (newsletters require dedicated SMTP), and any practice compromising network integrity or other customers.

8. Suspension and termination

Nebular may suspend or terminate services immediately for violations of these Terms or AUP, non-payment per section 5, court order, or infrastructure risk. Whenever feasible, we notify the Customer beforehand for remediation. Data remains available for 30 days after termination for potential reactivation.

9. Intellectual property

The Nebular brand, site layout, panel code, documentation, and marketing materials are exclusive property of Nebular, protected by copyright and trademark law. The Customer retains full rights over data and content they host. We claim no rights over Customer files; access occurs only upon explicit authorization (for support) or legal obligation.

10. Limitation of liability

Nebular is not liable for: data loss when the Customer did not use provided backup tools; unavailability caused by force majeure or attacks exceeding contracted mitigation capacity; indirect damages or lost profits. In any case, aggregate liability is limited to the amount effectively paid by the Customer in the 12 months prior to the event.

11. SLA and availability

We guarantee 99.9% monthly uptime (maximum 43 minutes of downtime/month). In case of proven breach, the difference is credited proportionally in the next cycle. Scheduled maintenance windows are announced 72 hours in advance and do not count toward the SLA calculation. Operational details are available on a dedicated technical page.

12. Changes, governing law, and venue

These Terms may be updated; material changes will be communicated with at least 30 days' notice. The current version prevails from the date indicated at the top. Brazilian law applies exclusively. The courts of São Paulo/SP are elected to resolve any disputes, waiving any other forum, however privileged.
